Subscription Terms

These Subscription Terms (these "Terms") are entered into between you and Fygo ("we," "us," or "our") and apply to all subscription services you purchase through the fygonas.shop, fygonas.com, including subscriptions to virtual goods and paid features (collectively, the "Subscription Services").
Please read these Terms carefully before confirming your subscription. By clicking "Agree & Subscribe" (or a similarly worded button) on the subscription confirmation page, you acknowledge that you have read, understood, and agree to be bound by: (a) these Terms; (b) the product-specific information displayed on the purchase page at the time you subscribe, including price, subscription, billing cycle, feature descriptions (such as file systems, remote access, built-in apps, user limits, storage devices, app center, and included updates), free trial arrangements, refund terms, and other offer details (the "Offer Details"); and (c) the Terms of service (the "Terms"). If you do not agree to any of the foregoing, do not confirm your subscription.
PLEASE NOTE: UNLESS YOU CANCEL IN ACCORDANCE WITH THESE TERMS BEFORE THE END OF THE CURRENT SUBSCRIPTION PERIOD, YOUR SUBSCRIPTION (INCLUDING UPON EXPIRATION OF ANY FREE TRIAL) WILL AUTOMATICALLY RENEW AND YOUR PAYMENT METHOD WILL BE CHARGED;
1. Applicability and Order of Precedence
A. Applicability. These Terms apply to all subscription services you purchase through the fygonas.shop, fygonas.com, including subscriptions to virtual goods and paid features, and constitute the general terms between you and us governing subscription matters.
B. Offer Details. The specific commercial terms of each subscription product—including without limitation the price, billing currency, billing cycle, availability and duration of any free trial, the charges that apply after a free trial ends, feature descriptions, and the method of cancellation shall be as set forth in the Offer Details displayed to you on the purchase page at the time you complete your subscription. The Offer Details form an integral part of these Terms and, together with these Terms, constitute the entire agreement between you and us with respect to that subscription product. We will disclose the foregoing information to you clearly and conspicuously on the purchase page before you incur any payment obligation.
C. Relationship to the Master Agreement. Matters not addressed in these Terms are governed by the Master Agreement. The provisions of the Master Agreement regarding accounts, intellectual property, user conduct, disclaimers and limitations of liability, governing law, and dispute resolution (including any arbitration clause and class action waiver, as applicable) apply to your purchase and use of the Subscription Services.
D. Reservation of Consumer Rights. Nothing in these Terms excludes, limits, or modifies any rights you may have under non-waivable consumer protection laws of your state of residence. If any provision of these Terms conflicts with such mandatory laws, such laws shall prevail, but only to the extent of the conflict and as required thereby.
2. Automatic Renewal & Billing
A. Authorization to Charge; Express Consent. Before you incur any payment obligation, we will clearly and conspicuously disclose the automatic renewal terms on the purchase page, including the fact that the subscription will automatically renew, the recurring fee, the billing cycle, and how to cancel. By clicking to confirm your subscription after such disclosure, you provide your express informed consent to the automatic renewal arrangement and authorize our designated third-party payment processor to charge the payment method you provided during checkout the subscription fee set forth in the Offer Details at the beginning of each billing period. If the subscription includes a free trial, the first charge will occur upon expiration of the free trial (unless you cancel before the trial ends).
B. Automatic Renewal. Unless you cancel your subscription at least 24 hours before the end of the current billing period in accordance with Section 5, your subscription will automatically renew for successive periods of the same duration as stated in the Offer Details, at the price applicable at the time of renewal, and your payment method will be charged automatically. Our designated third-party payment processor may charge your payment method for the next period within 24 hours prior to the end of the current period.
C. Renewal Reminders. We will send you a reminder before a charge occurs—via the email address associated with your account and push notification—stating the upcoming renewal, the renewal fee, the charge date, and how to cancel, in the following circumstances: before renewal of any subscription with a billing cycle of one year or longer; Please note: these reminders are provided for your convenience in managing your subscription; failure to receive a reminder does not invalidate the express consent to automatic renewal you provided at the time of subscription, nor does it relieve you of the need to cancel before the end of the current period if you wish to stop the renewal, except as otherwise required by mandatory applicable law.
D. Price Changes. If we change the renewal price of a Subscription Service, we will provide you with reasonable advance notice through the via email before the new price takes effect. Where applicable law requires your affirmative consent to a price increase, your subscription will not renew at the new price without such consent. If you do not accept the new price, you may cancel your subscription before the new price takes effect.
E. Payment Processor: All transactions and billing are securely handled directly by our designated third-party payment processors. We do not collect or store your financial or credit card information.
3. Eligibility
Accounts are available only to adults who are at least 18 years of age (or the age of majority in your state of residence, whichever is higher) and who have full capacity to contract. By purchasing a subscription, you represent and warrant that: (a) you are at least 18 years of age or the age of majority in your state of residence; and (b) you have the legal capacity to enter into a binding contract.
4. Free Trials & Promotional Offers
A. Trial Terms Disclosed in Offer Details. We may, at our discretion, offer free trials or promotional pricing (such as discounted introductory rates) for certain Subscription Services. The duration of any free trial or promotional period, the price that will apply after it ends, and the date on which the first (or standard-rate) charge will occur shall be as stated in the Offer Details displayed to you before you subscribe.
B. UNLESS YOU CANCEL AT LEAST 24 HOURS BEFORE THE END OF THE FREE TRIAL, YOUR TRIAL WILL AUTOMATICALLY CONVERT TO A PAID SUBSCRIPTION AND THE PAYMENT METHOD ASSOCIATED WITH THE THIRD-PARTY PAYMENT PROCESSOR WILL BE CHARGED THE SUBSCRIPTION FEE STATED IN THE OFFER DETAILS. If you cancel during a free trial, your access to the Subscription Services may, end immediately upon cancellation or continue until the end of the trial period.
C. Eligibility; One Trial Per User. Unless otherwise stated in the Offer Details, each free trial or promotional offer is limited to one per user, account,and/or payment method.We reserve the right to determine your eligibility for any trial or promotional offer, and to revoke a trial or promotional offer and charge the standard price where we reasonably determine that you have created multiple accounts or otherwise acted to circumvent this limitation. Trial and promotional offers may not be combined with other offers, have no cash value, and are non-transferable.
D. Modification of Offers. We may modify or discontinue any free trial or promotional offer at any time on a prospective basis. Any such modification will not affect a trial or promotional period you have already commenced.
5. Cancellation
A. How to Cancel. You may cancel your subscription at any time by contacting us at [ feedback@fygo.io ]. To avoid being charged for the next billing period, your cancellation must be completed at least 24 hours before the end of the current billing period (or, for free trials, at least 24 hours before the end of the trial).
B. Effect of Cancellation. Upon cancellation, your subscription will remain active until the end of the billing period you have already paid for, after which it will not renew. Except as provided in Section 8.C, as stated in our Refund Policy, or as required by applicable law, cancellation does not entitle you to a refund of fees already paid for the current billing period.
6. Refunds
A. In principle, the Service cannot be returned or resold.
B. In the rare cases where a refund is approved by our customer service team after individual assessment, the refund will be processed and issued to your original payment method within 10 business days. For specific return and refund terms, please refer to our Refund Policy.
7. Price Changes
A. We may change the price of a Subscription Service from time to time. If we increase the renewal price of your existing subscription, we will notify you at least thirty (30) days before the new price takes effect (or such longer period as applicable law requires), via the email address associated with your account. Any price change will apply only to billing periods beginning after the new price takes effect; we will not change the price for a billing period you have already paid for.
B. Where applicable law require your affirmative consent to a price increase, your subscription will not renew at the increased price unless you provide such consent, and if you do not, your subscription may be canceled or may lapse at the end of the current period.In all other cases, if you do not agree to the new price, you may cancel your subscription in accordance with Section 6 before the new price takes effect; if you do not cancel, your continued subscription will renew at the new price, and this will constitute your acceptance of the new price to the extent permitted by applicable law.
8. Subscription Services; Virtual Goods; Modifications
A. Scope of Subscription Services. The Subscription Services consist of the services described on fygonas.shop and the paid features, content, and/or virtual goods described in the applicable Offer Details. Certain features of the Subscription Services depend on compatible hardware devices, firmware, your device's operating system, Bluetooth or network connectivity, and/or services provided by third parties; the availability and performance of such features may be affected by factors outside our reasonable control.
B. Virtual Goods. Virtual goods made available through the Subscription Services (such as system, in-app content, virtual items, characters, "Virtual Goods") are licensed to you, not sold. You receive a limited, personal, non-exclusive, non-transferable, revocable license to use Virtual Goods solely within the App for your household's personal, non-commercial use. Virtual Goods have no monetary value, may not be redeemed for cash or anything of value outside the App, and may not be sold, traded, or transferred. Except as required by applicable law or as expressly provided in these Terms, Virtual Goods that expire with your subscription or that are consumed through use are not refundable.
C. Modifications to the Subscription Services. We are continuously improving the Service and may update, add, or modify features of the Subscription Services from time to time. If we make a change that materially reduces the core functionality of a Subscription Service you have paid for, or if we discontinue a Subscription Service, we will provide you with at least thirty (30) days' advance notice where reasonably practicable, and you will be entitled to: (a) cancel your subscription in accordance with Section 5; and (b) receive a pro-rata refund of prepaid fees covering the remaining portion of your then-current billing period after the change or discontinuation takes effect, processed through such means as we may reasonably designate. Routine updates, bug fixes, security patches, and changes that do not materially reduce core functionality do not trigger the foregoing rights.
9. Dispute & Chargeback Policy
A. Contact Us First. If you have any questions or concerns about a charge (including activation issues, upgrade failures, or service unavailability), we encourage you to contact us at[ feedback@fygo。io ] before disputing the charge with your bank, card issuer, or payment provider. Most issues can be resolved quickly through our support team, including by refund where applicable under Section
B. Our Response Commitment. We will respond to billing inquiries within forty-eight (48) hours (excluding statutory holidays) and will use reasonable efforts to resolve the matter within ten (10) business days.
C. Effect of a Chargeback. Once a chargeback is filed with your card issuer, the matter is handled through the card network's dispute process, and we are no longer able to issue a refund for that charge directly through customer service.
D. Delivery Records. You acknowledge that the Service consists of digital products delivered electronically. In responding to any dispute or chargeback, we may submit records evidencing delivery and use of the Service, including subscription activation logs, license issuance records, account tier changes, access logs, IP address and device information associated with the purchase, the timestamp of your acceptance of this Agreement, and customer service correspondence.
E. Abusive Disputes. If we determine in good faith that a chargeback is fraudulent or abusive—for example, a dispute filed as "unauthorized" or "not received" with respect to a subscription that was activated and used under your account—we reserve the right to suspend or terminate your account, refuse future transactions, and pursue recovery of resulting losses, in each case to the extent permitted by applicable law.
